1. Acceptance of Terms

Welcome to GrowCommerce. These Terms of Service ("Terms") govern your access to and use of GrowCommerce's website, WordPress plugins, and Shopify app (collectively, the "Services").

These Terms constitute a legally binding agreement between you and GrowCommerce ("Company," "we," "us," or "our"). GrowCommerce offers WordPress plugins available on WordPress.org (free) and growcommerce.io (Pro), and a Shopify app with a free plan and paid Pro options.

2. Account Registration

2.1 Eligibility

To use our Services, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable laws
• Provide accurate and complete registration information

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access at support@growcommerce.io
• Using strong, secure passwords for your account

2.3 Account Information

You agree to provide accurate, current, and complete information during registration and to keep it up to date. GrowCommerce reserves the right to suspend accounts with inaccurate or misleading information.

We reserve the right to modify, update, or discontinue any aspect of our products or services at any time. We will make reasonable efforts to communicate significant changes to active users, but we do not guarantee advance notice for all changes.

Support is provided via our support page at growcommerce.io/support and by email at support@growcommerce.io. We aim to respond to all support requests as promptly as possible during business hours.

4. Payment & Billing

4.1 Pro Plans & Subscriptions

Pro versions of our WordPress plugins and GrowInsights360 are sold as subscriptions through growcommerce.io. The Shopify app Pro plan is billed through the Shopify billing system. Current pricing is available on our Pricing page and is subject to change.

4.2 Payment Terms

• Payment Processor: WordPress plugin and GrowInsights360 subscriptions are processed via PayPal
• Shopify App Billing: Managed through Shopify's own billing system
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled
• Currency: All prices are in USD unless otherwise stated

4.3 Refund Policy

4.4 Subscription Cancellation

You may cancel your subscription at any time:

• Directly from your PayPal account's subscription management page (for WordPress plugin and GrowInsights360 plans)
• Through your Shopify admin panel (for Shopify app plans)
• By submitting a cancellation request to support@growcommerce.io

Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date.

4.5 Taxes

Prices shown do not include applicable taxes. You are responsible for any taxes associated with your purchase.

5. Acceptable Use Policy

You agree not to use our Services to:

Violation of this policy may result in immediate account suspension or termination without refund.

6. Intellectual Property Rights

6.1 Our Rights

All intellectual property rights in our products and services — including plugin code, designs, trademarks, and website content — are owned by or licensed to GrowCommerce. You may not:

• Copy, modify, or create derivative works of our plugins or software
• Reverse engineer, decompile, or disassemble our software
• Remove or alter any proprietary notices
• Redistribute, resell, or sublicense our Pro plugins without written consent
• Use our trademarks or branding without prior written consent

6.2 Your Content

You retain all rights to your store data, customer data, and business information processed by our plugins or services. We do not claim ownership of any such data.

6.3 Feedback

If you provide feedback or suggestions about our products, we may use them to improve our services without any obligation or compensation to you.

7. Warranties & Disclaimers

7.1 Service Warranty

We make reasonable efforts to ensure our plugins and services function as described in our documentation. This warranty does not apply if:

• The plugin is modified by anyone other than GrowCommerce
• Issues result from incompatible third-party plugins, themes, or hosting environments
• You are using an outdated version of the plugin
• Issues arise from misuse or failure to follow our documentation

8. Limitation of Liability

8.1 Liability Cap

To the maximum extent permitted by law, our total liability to you for any claims arising from these Terms or your use of our products shall not exceed the amount you paid us in the 12 months preceding the claim.

8.2 Excluded Damages

We shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from third-party plugin or theme conflicts
• Issues caused by your hosting environment or server configuration

9. Termination

9.1 Termination by You

You may cancel your subscription and terminate your account at any time by contacting our support team at support@growcommerce.io or by cancelling directly through PayPal or Shopify. Access to Pro features continues until the end of your current billing period.

9.2 Termination by Us

We may suspend or terminate your access immediately if:

• You breach these Terms
• Your account is used for illegal or abusive activities
• Your subscription payment remains unpaid
• Required by law or a court order

9.3 Effects of Termination

Upon termination:

• Your access to Pro features will be revoked
• Your license key will be deactivated
• We may delete your account data after a reasonable period

10. Dispute Resolution

10.1 Informal Resolution

Before raising any formal claim, you agree to contact us at support@growcommerce.io to attempt to resolve the dispute informally. We will make reasonable efforts to resolve issues promptly.

10.2 Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes that cannot be resolved informally shall be subject to the jurisdiction of the courts of India.

10.3 No Class Actions

Any disputes will be resolved on an individual basis. You agree not to participate in class action or representative proceedings against GrowCommerce.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GrowCommerce regarding your use of our products and services.

11.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

11.4 Updates to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of our products after any change constitutes your acceptance of the updated Terms.
